The Service is intended for users and customers located in the United States. We do not currently ship products anywhere outside the United States. We reserve the right to refuse, cancel, or refund any Order that requires shipment to a location outside the United States or to any location We do not serve.

Interpretation and Definitions

Interpretation

The words whose initial letters are capitalized have meanings defined under the following conditions. The following definitions have the same meaning regardless of whether they appear in singular or plural.

• Goods or Products means garlic, seed garlic, farm products, agricultural products, merchandise, subscriptions, or other items offered for sale through the Website.
• Orders means requests by You to purchase Goods from Us through the Website or any other approved sales channel.
• Promotions means discounts, coupons, special offers, promotional codes, giveaways, limited-time offers, or other promotional campaigns offered by Us.
• Service refers to the Website and related online services, including account features, product listings, checkout, payment processing, subscriptions, communications, customer support, and related website functionality.
• Subscriptions means any recurring, seasonal, prepaid, or membership-based product plan offered by Us through the Website.

Purchases of Goods

Users may purchase Goods through the Website. By placing an Order, You represent that all information You provide is accurate, complete, and current, including billing information, shipping information, payment information, and contact details.

All Orders are subject to acceptance and availability. We reserve the right to refuse or cancel any Order for any reason, including but not limited to product availability, pricing errors, suspected fraud, shipping restrictions, product-quality concerns, weather or crop conditions, payment issues, or errors in product descriptions or availability.

Product descriptions, photos, weights, sizes, packaging, harvest timing, planting recommendations, and availability information are provided for general informational purposes. Agricultural products are natural products and may vary in size, appearance, weight, color, shape, curing, packaging, and seasonal availability.

Prices are subject to change without notice. Unless otherwise stated, prices do not include applicable taxes, shipping, handling, or other charges.

Payments

Payments through the Website may be processed using WooPay, Stripe, credit card processors, or other third-party payment services.

By placing an Order, You authorize Us and Our payment processors to charge the payment method You provide for the total amount of Your Order, including product price, shipping, taxes, fees, subscription charges, and any other applicable charges.

We do not control third-party payment processors and are not responsible for payment delays, processor errors, account holds, declined transactions, fraud-prevention actions, or other payment-processing issues caused by third-party services.

Subscription Plans

We may offer subscription plans, seasonal plans, recurring product plans, memberships, or other subscription-based offerings through the Website.

Subscription terms, billing frequency, product contents, delivery timing, renewal terms, cancellation terms, and pricing may vary by plan and will be described at the time of purchase or signup.

By purchasing a Subscription, You authorize Us or Our payment processor to charge Your payment method on a recurring basis according to the subscription terms presented at checkout or otherwise disclosed to You.

You are responsible for keeping Your billing, shipping, and account information current. We may suspend, cancel, or delay Subscription shipments if payment fails, product is unavailable, weather or crop conditions affect fulfillment, or shipping information is incomplete or inaccurate.

Unless otherwise stated in the applicable Subscription terms, You may cancel future subscription renewals through Your account or by contacting Us. Cancellation will not automatically refund amounts already charged or Orders already processed, shipped, harvested, packed, reserved, or prepared for fulfillment.

We reserve the right to modify, pause, discontinue, substitute, or cancel Subscription plans at any time, including due to crop availability, weather, seasonal constraints, operational needs, or business changes.

Promotions, Discounts, and Coupons

We may occasionally offer Promotions, discounts, coupons, promotional codes, bundles, special pricing, seasonal offers, or other limited-time offers.

Promotions are subject to any terms, expiration dates, limitations, exclusions, minimum purchase requirements, product availability, and other conditions stated at the time of the Promotion.

Unless otherwise stated, Promotions may not be combined with other offers, have no cash value, are non-transferable, and may be modified, suspended, or discontinued at any time.

We reserve the right to cancel Orders, refuse discounts, or revoke Promotions in cases of suspected fraud, abuse, error, misuse, duplicate use, technical failure, or violation of these Terms.

Geographic Availability

The Website and products are intended for customers located in the United States.

We do not currently ship products anywhere outside the United States.

We reserve the right to refuse, cancel, or refund any Order that requires shipment outside the United States, to a location We do not serve, where shipment is restricted, where agricultural products may be subject to special import, planting, quarantine, customs, or regulatory controls, or where shipment is not commercially practical.

You are responsible for providing a valid United States shipping address. If You provide a shipping address outside the United States, We may cancel and refund the Order, less any non-refundable payment processing, administrative, or other costs permitted by these Terms and applicable law.

Shipping and Delivery

Shipping Options

Orders are usually shipped using USPS Priority Mail and USPS Ground Advantage. Sometimes We may ship using UPS, FedEx, or other methods.

If You have special shipping requests, please send Us a note before placing Your Order. We will try to accommodate reasonable requests, but We cannot guarantee that special shipping requests will be available or accepted.

Processing Time

The normal processing time for Orders is 3–5 business days before shipment. Delivery times normally take 1–5 days to the Continental United States after shipment.

Processing and delivery times are estimates only and are not guaranteed. Processing or delivery may be delayed by order volume, seasonal harvest timing, weather, crop conditions, carrier delays, address issues, holidays, product availability, or other circumstances outside Our control.

Seasonal Ordering of Hardneck Garlic

Pre-orders for Hardneck Garlic generally ship in September through October for the upcoming season.

Your Order may be delayed based on the growing season in Your area according to the ZIP code on Your delivery address, product availability, harvest and curing conditions, or the order in which Orders were received.

Otherwise, Orders for in-stock garlic typically process in 3–10 business days.

If You need garlic more urgently, please include Your request in the notes section when placing Your Order and select Priority shipping during checkout. We will try to accommodate urgent requests when possible, but We cannot guarantee expedited processing or delivery.

Shipping Addresses

You are responsible for providing a complete and accurate shipping address. We are not responsible for lost, delayed, returned, misdelivered, or undeliverable packages caused by incorrect, incomplete, outdated, or inaccessible shipping information provided by You.

If an Order is returned to Us because of an incorrect or undeliverable address, You may be responsible for additional shipping charges to resend the Order, and shipping charges may not be refundable.

Carrier Delays and Risk During Transit

Delivery times are estimates and may vary by carrier. We are not responsible for carrier delays, weather delays, service interruptions, tracking errors, scanning delays, delivery exceptions, lost packages, stolen packages after delivery confirmation, or damage caused by events outside Our control.

Please contact Us if there is a problem with Your shipment, and We will work with You and the carrier where reasonable.

Transfer of Title for Products That Are Ordered

For purposes of transfer of title and as it relates to sales tax remittance, if any, title has not transferred to You for the product or products You ordered until Your products have shipped or have been picked up by You or Your agent.

Your Order will be considered complete when the product or products have shipped or have been picked up by You or Your agent. The title transfer date will be the date Your product or products have shipped or have been picked up.

Returns and Exchanges

Because We sell farm products, agricultural products, and seasonal goods, return and refund rights may be limited. Unless otherwise noted on Your Order, the following return and exchange terms apply.

Cancelling an Order That Has Not Shipped

If You need to cancel Your Order before it has shipped, please contact Us. If the Order has not shipped, We will refund Your Order less a 10% processing fee.

We may be unable to cancel an Order that has already been packed, prepared for shipment, picked up by a carrier, shipped, harvested specifically for Your Order, reserved, or otherwise processed.

Refund Policy

Unless otherwise noted on Your Order, Our refund and returns policy lasts 3 days.

If 3 days have passed since You received Your item, We cannot offer You a full refund or exchange.

To be eligible for a return, Your item must be unused and in the same condition that You received it. It must also be in the original packaging.

To complete Your return request, please provide Us with:

• Your receipt or proof of purchase;
• pictures of the product in question;
• a description of the issue;
• Your order number and contact information.

Unless otherwise noted on Your Order, You have 3 days from the date Your Order has been delivered to request a refund.

Returning Your Product

To return Your product, You should mail Your product to the shipping-from address listed on Your Order’s original shipping label, unless We provide different return instructions.

You are responsible for paying Your own shipping costs for returning Your item. Shipping costs are non-refundable.

If You receive a refund, the cost of return shipping may be deducted from Your refund.

Depending on where You live, the time it may take for an exchanged product to reach You may vary.

Processing Your Return

Once Your return is received and inspected, We will send You an email to notify You that We have received Your returned item.

We will also notify You of the approval or rejection of Your refund.

If Your return is approved, Your refund will be processed, and a credit will automatically be applied to Your credit card or original method of payment within a reasonable number of days, subject to payment processor and bank processing times.

Non-Returnable or Limited-Return Items

Certain agricultural, perishable, seasonal, planted, opened, used, damaged, or time-sensitive products may not be eligible for return or exchange.

We reserve the right to deny refunds or exchanges where products have been used, planted, altered, stored improperly, damaged after delivery, returned outside the return window, or otherwise fail to meet the conditions of this policy.

Seed Garlic and Agricultural Product Information

All of Our Seed Garlic varieties have tested negative for garlic bloat nematode, white mold, and botrytis by the University of Maine Plant Disease Diagnostic Laboratory for Garlic Seed Testing.

Agricultural performance may vary based on climate, soil, planting time, storage, curing, irrigation, fertility, pest pressure, disease pressure, handling, local growing conditions, and the skill and practices of the grower.

Any growing information, planting guidance, variety descriptions, harvest timing, or agricultural recommendations provided through the Service are for general informational purposes only and are not guarantees of performance, yield, disease resistance, storage life, or results.

You are responsible for determining whether any agricultural product is suitable for Your location, climate, soil, intended use, planting schedule, growing practices, and applicable laws or regulations.

Intellectual Property

The Service and its original content, features, functionality, logo, name, visual design, text, graphics, images, photographs, icons, layout, branding, trademarks, trade dress, product descriptions, and other materials are and will remain the exclusive property of the Company and its licensors.

Our content, logo, visual design, trademarks, service marks, trade names, branding, and other intellectual property may not be copied, modified, reproduced, republished, uploaded, posted, transmitted, displayed, distributed, sold, licensed, or otherwise used without Our prior written permission.

Nothing in these Terms grants You any right, title, or interest in or to Our intellectual property except for the limited right to access and use the Service in accordance with these Terms.

Feedback and Suggestions

If You provide Us with Feedback, You agree that We may use, implement, modify, publish, commercialize, or otherwise exploit such Feedback for any purpose without restriction and without compensation, credit, notice, approval, or obligation to You.

You agree that any Feedback You provide is voluntary and does not create any ownership right, confidentiality obligation, employment relationship, partnership, joint venture, or right to compensation.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms.

Upon termination, Your right to use the Service will cease immediately.

Termination may include suspension or deletion of Your account, cancellation of Orders or Subscriptions, refusal of future service, removal of User Content, or restriction of access to the Website.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers, service providers, employees, contractors, owners, members, managers, agents, or affiliates under any provision of these Terms, and Your exclusive remedy for all of the foregoing, shall be limited to the amount actually paid by You through the Service or 100 USD if You have not purchased anything through the Service.

• that any agricultural product will perform in a particular way under Your growing, planting, storage, or use conditions.

If You have any concern or dispute about the Service, an Order, a Product, a Subscription, a refund, or these Terms, You agree to first try to resolve the dispute informally by contacting the Company.

United States Legal Compliance

You represent and warrant that:

• You are not located in a country that is subject to a United States government embargo or that has been designated by the United States government as a “terrorist supporting” country; and
• You are not listed on any United States government list of prohibited or restricted parties.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
